The Study On The Compulsory Performance Of The Right To Request

The right to enforce the request is also called the right to continue the request,and the compulsory performance is what we usually say.To enforce the claim is a force of the right to request payment,namely for execution,but a noteworthy problem is the relationship between the obligation and liability for breach of contract.The compulsory execution of the right of request is the compulsory performance of the debt,which is different from the liability for breach of contract.Although it is not a liability for breach of contract,it has the effect of remedies for breach of contract.The author will discuss the relevant laws and related judicial interpretations in China,and further improve the mandatory performance system based on the relevant foreign legislative provisions.This article is divided into three parts.The first part is the summary of the right to perform the right of request,from the perspective of jurisprudence,to analyze the legal basis of the right to enforce the request.The second part of the article discusses the applicable conditions and exercise restrictions of the right to enforce the request.The third part is the study and analysis of the exclusion and defense of the right to perform the compulsory performance.
