Research On The Prevention Of Wrongful Convictions Based On Evidence-based Method

Wrongful convictions are common in judicial practice,to a certain extent,will have a negative impact on the credibility of the judiciary.The state from the institutional level of criminal proceedings to regulate the procedures to prevent the emergence of wrongful convictions.This paper intends to use interdisciplinary research methods to introduce evidence-based into the field of the prevention of wrongful convictions.On the one hand,it can enrich the research theory,on the other hand,find a new entry point for the prevention of wrongful convictions and enhance the operability of practice.In the study of the use of evidence-based approach to the prevention of wrongful convictions,this paper mainly discusses from four aspects.First,the basic concepts involved in the study are introduced,and the scope of the article and the basic foothold are clarified.At the same time,this paper analyzes the characteristics and theoretical basis of the prevention of wrongful convictions by this method,and proves the feasibility of this method;Secondly,it finds out the problems existing in the present practice and explores the solution to the problem by evidence-based methods and proves the necessity of applying it to the field of the prevention of wrongful convictions;Thirdly,elaborate on the evidence-based approach to the prevention of wrongful convictions of the various subjects and their basic functions,as well as the interrelationship between the various subjects.Based on the application of evidence-based methods in other disciplines,combined with the characteristics of judicial practice,to build specific process of evidence-based approach to prevent wrongful convictions;Finally,the guarantee mechanism of the whole process operation is explained,and the manpower and other resources needed in the application process of evidence-based method are explored.Through the above research,clear the details of evidence-based methods to prevent wrongful convictions,ensure that this method in the judicial practice can be properly applied.
