An Analysis Of Local Legislation Prohibiting “NEET”

China has entered the aging society,especially for the protection of the rights and interests of the elderly.The phenomenon of “NEET” has a negative effect on the support of the elderly in China.Local legislation prohibits “NEET”,which is the refinement and expansion of the law for the protection of the rights and interests of the elderly.This article first analyzes the legislative purpose,legislative expression and responsibility setting of the prohibition of “NEET”,and makes clear the basic meaning of the legal provisions.After that,the author collated and analyzed the relevant disputes about the prohibition of “NEET” in the local legislation,and analyzed the value orientation of the two kinds of viewpoints.The third part,through the community interview and questionnaire survey,I will analyze the effectiveness of the legalization of the prohibition of “NEET”.Judging from the purpose of legislation,it is worth affirming the original intention of prohibiting the legislation of “NEET”.However,the moral entry law is faced with the problem of "defining difficulty" and "executing difficultly".From the effect of implementation,the legislation prohibits“Neet” to prevent the "worse" situation,but can not achieve "better" support the elderly,and it is difficult to produce the legal sense of deterrence and punishment effect.
