House is closely related to people's livelihood,the choice of buying and selling is not just an individual problem,more related to the development of market economy,the harmony and stability of the society,if development at random by housing prices,is bound to cause too much effect,so the city begins according to its own characteristics on some corresponding housing purchase restrictions.However,because the room is hard to find the phenomenon of a large number of existence,this makes a lot of people to seek a new way to buy homes,have appeared in this paper the status quo of borrowing name to buy a house.Borrow to buy a house is refers to the recorder in the name of the house and actually enjoy people not for the same,to borrow the name of the man borrow lend the nominal person entitled to purchase housing and registration in the lend in the name of person name,borrow celebrity is the actual owner of the building,famous for housing appearance in the form of registration.The property law in our country implements the housing registration system,but in real life,real right law cannot be completely truly reflect the true state of property rights of immovables,safeguard borrow name to buy a house transactions of real ownership rights to justice and maintain social stability development.This article take the thesis expatiates the method of derivation by judicial case,the application of the view of theory to practice analysis of characteristics in the process of a court in resolving disputes,so as to explore a more reasonable solution.Through in-depth analysis of the current mainstream viewpoints,the author thought that to borrow to buy a house contract the nature of the identified as a nameless contract more reasonable,the effectiveness of the contract can be from two Angle from the internal and external,internal contract legal and effective,usually want to combine the third person to discriminate between external contract.About borrow to buy a house last property ownership,in does not involve the third person to lend the name of a person without special care is necessary,in relation to the third person,want to consider whether to goodwill,emphatically to decide again.
