Research On Prosecutorial Supervision Of Civil False Litigation

False litigation is a behavior in which a participant in a civil action seeks illegal interests or evades statutory obligations,falsifies facts or conceals the truth,falsifies evidence,brings civil lawsuits to the courts,and causes the courts to make erroneous decisions.Civil fraud lawsuits not only infringe on the legitimate rights and interests of the state,the collective,or others,but also damage the normal litigation activities of the people's courts and have serious social harm.The legal order and balance of interests that are destroyed by false lawsuits need to be restored through supervision.The procuratorial organs,as the state's legal supervisory authority and the maintainer of public interest,should do something.In recent years,procuratorial organs have obtained certain results in carrying out procuratorial supervision over false lawsuits.With certain experience,they still face many difficult problems and institutional difficulties.This article discriminates the concept from the perspective of procuratorial supervision of false litigation,and on the basis of analyzing the current plight of false litigation and prosecutorial supervision,it puts forward suggestions to improve the supervision and supervision of civil false litigation,that is,based on the definition of false lawsuit in the legal regulation level.,Unblock the case information channels,improve the means of supervision,establish a linkage mechanism,and form a joint force to punish sham litigation so as to benefit the judicial practice.
