With the implementation of the Criminal Law Amendment(9),life imprisonment appeared for the first time in the articles of the Criminal Law of our country.It has attracted the attention of many scholars and practitioners,and has also taken on the heavy task of continuing to improve the penal structure.It also takes into account the practical needs of carrying out strict control,using the death penalty prudently and punishing the crime of corruption and bribery.At present,there are still many controversies about the nature of life imprisonment.The case of Bai Enpei has also played a certain research value in the study of life imprisonment,especially the retroactive effect of life imprisonment system in the judicial practice of our country.Compared with our country in the application and classification of the foreign life imprisonment system,with the development of our country's criminal law theory and the concept of foreign criminal legislation,we should regard life imprisonment as one of the legal punishment in our country.The system of life imprisonment has become a kind of independent punishment in some countries.The system of life imprisonment in our country needs to be further perfected in its application,and it should be further standardized in its application.And on the basis of strict restriction of death penalty,the scope of application of life imprisonment should be appropriately expanded and the applicable conditions should be clearly defined.In the judicial field,China needs to continue to improve the supervision and management of prisons and serve their sentences.In short,life imprisonment should be brought into our country's penalty system and regarded as a kind of penalty,which can maximize its value in the future judicial practice.It will play a positive role in the reform and construction of our penal system.
