Study On The Execution Of Life Imprisonment

With the formal promulgation of the amendment of the criminal law(nine),the "life imprisonment" first appeared in the criminal code of our country,and it has become a special punishment on the basis of the original life imprisonment of our country.Life imprisonment is regarded as a very strict free punishment in the study of criminal law,which is characterized by the deprivation of the perpetrator's freedom of life.In modern times,life imprisonment has been widely adopted by the criminal law in many countries.Prior to that,the term "life imprisonment" was often used to refer to life imprisonment for foreign countries.Based on the background of strengthening anti-corruption efforts and strictly controlling the death penalty,life imprisonment has become a popular topic in academic circles since the introduction of the criminal law amendment(nine).At the same time,as the criminal law circles and the practical circles heated the discussion,for the prison,the executive regulator,the restriction of the parole and the deprivation of life free will bring a great impact on the execution of the prison.The prison system will face many problems arising from the penalty measure of life imprisonment.Based on this background,it is necessary to discuss these problems and give countermeasures.As far as the execution of life imprisonment is concerned,prisons must be based on reality and change their concepts,constantly improve implementation measures and improve corresponding systems.This paper,based on the concept and characteristics of life-long imprisonment measures,is combined with the author's experience in work,analyzes the implementation of life imprisonment,and tries to give corresponding countermeasures while analyzing the problems.As a prison for executing places and organs,the implementation of this criminal law will not only highlight the existing defects in the prison system in various aspects such as the incentive system,education and labor mechanism,classification mechanism and medical security,but also expose the existence of some questions caused by life-long prison prohibition as a penalty measure itself.The defects and reasons for the system of life imprisonment and its possible countermeasures will be discussed in this paper.This article will also make a horizontal comparison through the analysis of the implementation of various countries,and give specific solutions to the specific cases.Finally,it puts forward some suggestions on perfecting the system of life imprisonment and promoting the reform of penalty execution in China.The article is divided into three parts.And the first part is the introduction,involved in the background about the introduction of life-long imprisonment measures;the second part is the main body of the article,introducing the overview of life imprisonment and analyzing its implementation problems;the third part of the article is the conclusion,pointing out the shortage and putting forward the prospect.
