The comprehensive promotion of the river chiefs system has provided a new institutional guarantee and implementation path for China's water environmental governance.The river chiefs system draws on the constraints,incentives,and competition mechanisms in the administrative system.The river chiefs system has made clear that local party and government leaders are responsible for the overall responsibility for environmental quality and have integrated the strength of party committee and government at all levels.At the same time,long river chiefs system also reinforces the effect of the implementation of regulations.At this stage,however,the institutional nature of China's river chiefs system is not outstanding,and the problems related to the construction of the relevant system are obvious.A review of the existing documents and issues of the river chiefs system and the related recommendations are helpful to provide a certain reference for the further construction of China's river basin system.The study on the institutionalization of China's river chiefs system mainly consists of four aspects: the concept and theoretical basis of the river chiefs system,the text review related to the river chiefs system,the inspection of the river chiefs system,and the corresponding improvement measures..In order to study the river length system,it is necessary to clarify the connotation of the “main body” and the “object” in the concept of the river length system,and to deeply analyze and define it,and find out the internal logic sequence of the river length system concept.In this way,it is possible to establish the connotation of the subject and object of the river system in the institutional context.At the same time,as a water environment management system,River chiefs should also have the theoretical basis of environmental law.Among them,the environmental public trust theory and the overall government theory provide the basic theoretical support for the source of authority,unified leadership,and the direction of multi-headed cooperation in the construction of the river chiefs system.The examination of the river chiefs system is mainly divided into the inspection of policy documents of the river chiefs system and the inspection of the relevant legislation of the river chiefs system.After inspection,it was found that the policy document of the river chiefs system is the basic support for the establishment of the river chiefs system in China.The existence of generality and political characteristics is one of the sources of a series of legal problems in the implementation of the river chiefs system.At the same time,China's river chiefs system has been identified as a legal system for water environment management at the legislative level.The relevant regulations and local regulations related to the river chiefs system also provide a certain reference for the relevant issues such as assessment and accountability of the river chiefs system.The examination of the problem of the river chiefs system is based on the examination of the river-length documentation,combined with the problems existing in the implementation of the river-changing system in China.The study found that it has been found that the institutionalization of China's river chiefs system is mainly concentrated in four areas: First,the non-statutory determination of the powers of authority;the conflict between the authority of River chiefs and the current management authority related to the water environment;Second,problems such as confusion in the assessment subjects and unclear assessment contents;Third,because of the lack of legislation,the scope of the accountability subject is narrow,and the responsibility system for accountability is unbalanced;Fourth,the public participation system has problems such as the rough design of the system,the lack of motivation and the lack of incentives for public supervision.In response to the above issues,this paper proposes the following suggestions:The first is to study the statutory direction of the authority of the river chiefs system,clarify the relationship between “responsibilities” and “power”,clarify the terms of reference for the river chiefs system and the existing water environment management agencies,and at the same time,establish the system of the power list to clarify the authority of the river;The second is to improve the evaluation system of the river chiefs system,on the one hand,the subject of the assessment is clearly defined,on the other hand,the evaluation content is improved through assessment of differentiation,specialization,and diversification.The third is to balance the responsibility system of the river chiefs system by clarifying the scope of the accountability subject with reference to the existing regulations,and re-demarcating the responsibility system ofthe river-changing system from vertical and horizontal respectively.Fourth,through the establishment of an open and transparent system and a reporting system,the system of public participation in the river chiefs system will be improved.
