Arbitration system originated in the west,originated in the western developed commercial trade,has a long history,as a kind of non-litigation dispute resolution mechanism,the development of arbitration is not plain sailing,after going through a series of difficulties and setbacks,arbitration has the position of today.The success of western arbitration has shown that arbitration as a non-litigation dispute resolution mechanism has strong vitality and broad development prospects.Currently,the development of China's arbitration institutions appeared many problems,such as arbitration institution security administration,budget management chaos,not to raise,thus led to a decline in arbitration institution independence and neutrality,makes the arbitration ruling recognition fall,etc.,have seriously hindered the healthy development of arbitration system in our country,especially on the arbitration institution of folklore,is especially more disputes and problems.The purpose of this paper is to analyze the current status of the development of the arbitration institution in our country,on the basis of the arbitration institution in folklore road barriers and problems on carding analysis,to explore the reasons for their occurrence,and based on the mechanism of the composition of the arbitration organization and operation management mode,the analysis of the reference for the development of arbitration institutions in our country folk to provide some reference.This paper is based on the following structure:The first part of the article mainly expounds the evolution history and development of the arbitration institution in our country,and the arbitration agency folklore,the characteristics of the present development situation of the current,presents the advantages of arbitration compared with lawsuit,folklore and arbitration institutions analysis of the necessity of its development.The second part of this paper is mainly about the problems arising from the development of civil arbitration institutions and the analysis of causes.It is mainly from the appearance of the problems and the analysis of the causes.The third part of this paper is mainly to China's arbitration system environment and the concept of analysis,from the perspective of arbitration environment and the concept of culture,promote the renovation of the concept of arbitration in China,promote the legislation idea renewal,helping with the arbitration institution reform and further development of our country.With a view to summarizing some excellent experiences,the promotion has assisted the reform and further development of China's arbitration institutions.The fourth part of this article is mainly to suggestions on the development of the privatization of commercial arbitration institutions in China are put forward the domestic commercial arbitration institutions folk experience for reference,the scope of commercial arbitration institutions folk experience for reference,mainly from the legislation on the nature of arbitration institution and clear positioning,improve the system of financial management organization and personnel,improve the corresponding quality of agency personnel,establish a common supervision and administration institution,etc.,of folk commercial arbitration institution of China put forward some feasible Suggestions.In conclusion,this paper look forward to based on the careful analysis,explore the folk commercial arbitration institution of China facing the problems and reasons,and based on the composition of the arbitration organization mechanism and excellent analysis of the operation management mode,excellent experience for reference,for the study of the arbitration institution in our country.
