New Media Regulatory Research On Criminal Trial

Nietzsche,a famous German philosopher,had said in his talk about the fission of The Times that newspapers and modern technology are working together to force our souls to become strong and changeable.This sentence emphasizes the profound influence of the development of media on human society.Since the 21 st century,with the development and popularity of new media technology,people's work and life are increasingly filled with new forms of media,such as Weibo,WeChat,portal,Mobile client and so on.Frankly,the new media provides people with unprecedented user experience and convenience.However,everything has two sides.As new media bring a new world to people,it also leads to a series of new problems."How to regulate new media in criminal trials to avoid serious consequences?" That's one of the problems.In judicial practice,according to the characteristics of new media,China has enacted relevant laws and regulations to adapt new media to our legal environment.But on a specific level,its legislative speed is difficult to keep up with the rapid development of new media.New media content has some special characteristics,such as spread widely,quick speed,strong real-time and strong two-way interactive.But in view of the new media laws and regulations,they are legislative language confusion,weak pertinence.China has the largest number of mobile Internet users in the world.The use of new media in criminal trials is also at the forefront of the world.This means that China urgently needs to formulate a new media regulation mechanism suitable for its national conditions.In the face of this situation,it is very important to study the new media regulation in the process of criminal justice.This paper will base on the characteristics of criminal trial and new media,surrounding the new media used in the criminal trial,The court's regulation and application of new media in criminal trial,personal use of new media in criminal trial,suggestions on new media use regulation to build recommendations four parts to discuss.This paper embarks from the court and individual two main body,the new media can be divided into "service" and the extension of "people" two concepts.Based on the three basic values of freedom of speech,trial disclosure and judicial independence,this paper analyzesthe application of new media in three different stages after the criminal trial.The game of three basic values achieves the beneficial balance of new media intervention in criminal trial.At the end of this paper,some effective regulations are referenced,and some suggestions are put forward to solve the problems in the construction and practice of the new media regulation mechanism in China's criminal trial.There are many deficiencies in the article,which will be further improved in the future research.
