Research On Environmental Damage Judicial Authentication

After the unified management of forensic appraisal in China,in 2016,the environmental damage judicial appraisal formally introduced management regulations as the new category of judicial appraisal.Environmental protection is an important national policy for national governance.On January 18,2016,Chairman of the State Xi Jinping studied and implemented the spirit of the Fifth Plenary Session of the 18 th Party Congress at the provincial and ministerial level.Stressed that we must firmly promote green development,promote substantial natural capital appreciation,make good ecological environment a growth point for people's lives,and become a force-making point for displaying our country's good image,so that China's land is bluer,mountains are greener,and water is clearer.The environment is more beautiful and we are moving toward a new era of ecological civilization.China's forensic identification of environmental damage is one of the important components of environmental protection.It is still in its infancy and needs improvement.The scientific cause of environmental problems is the scientific basis for the legalization of environmental issues.The openness of the environment leads to the characteristics of difficult to define the causal relationship of environmental damage,complexity of technology,and compoundness of means.The solution to the problem of environmental damage forensic appraisal is not accomplished overnight.This paper selects institutional setup and qualification management issues,startup issues,and cross-examination and acceptance issues as the entry point to promote the perfection of environmental damage judicial appraisal issues.The development of environmental damage assessment agencies should follow the principles of overall planning,rational distribution,total control,and orderly development.In particular,the number of accreditation bodies must be strictly limited during the initial phase of auditing and registration to ensure a high level of qualifications.Set up a diversified start-up body and build a start-up mode led by the procuratorate.Establish a mechanism for coordinating with the judicial authorities to ensure that the appraisal expert's appraisal opinions meet the requirements of litigation.
