China's Fair Competition Review System And The Perfection Of Anti-monopoly Law

Since the implementation of the fair competition review system,all provinces and cities have issued implementation plans and gradually carried out the review work,the review mechanism has been established in most department and regions.However,as a new system,there is still a wide gap between the implementation of fair competition review and the requirement of full implementation.At the same time,the anti-monopoly law has been issued for ten years,and the problem of insufficient administrative monopoly regulation is becoming more and more obvious,calls for a revision of the antimonopoly law are also growing.It is a long-term process to change the inertia thinking of government departments to manage the economy by ruling out the competition,which requires the joint efforts of the fair competition review system and the anti-monopoly law enforcement.This paper studies the perfection of anti-monopoly law from the perspective of fair competition review system,concludes that the two are different in terms of regulation time and regulation scope,but all in order to maintain and promote market fair competition.Writing the fair competition review system in the antimonopoly law is not only the need to make up the deficiency of the antitrust law,but also to ensure the orderly development of the fair competition review system,and the need to establish the legal status of the competition policy.This article also studies the EU state aid control system,the OECD competition assessment toolkit and relevant countries,Australia legislative review principle and so on,from which it draws the inspiration of the aim and content selection of the revision of the antimonopoly law.Finally,in the summary review system of fair competition and the relationship between the anti-monopoly law and fair competition censorship outside experience concluded on the basis of fair competition censorship should write the conclusion of the anti-monopoly law,and put forward specific ideas and design to write.
