Research On The Rights Protection Of Anti-monopoly Law Enforcement In China

This paper describes the present situation of administrative counterpart rights protection in antimonopoly law enforcement in our country.It analyzes the problems in legislation,law enforcement and judicature of the protection of the rights of the administrative counterpart in anti-monopoly law enforcement.The paper uses the successful experience of other countries,especially the European Union and the United States in protecting the rights of the counterpart of anti-monopoly law enforcement as references.Then the author proposes some suggestions on legislation,law enforcement and judicature in the protection of the rights of the counterpart of anti-monopoly law enforcement.Adequate protection of the rights of the counterpart of anti-monopoly law enforcement can ensurethe judgmentjustice of the cases and restrict the administrative power within the framework of legal authorization.It can reduce the destruction to the market economy caused by the abuse of administrative power,which will occur only when all participants,including the legislative,law enforcement,judicature work towards the progress of the rule of law.
