A Research On The Perfection Of China's Value-Added Tax Deduction System

"Replacing the business tax with value-added tax" has realized the full coverage of China's VAT deduction scope,but the current system of VAT deduction in China still lacks scientific and legal design.The author analyzed the current situations of the current VAT deduction in China and the shortcomings of the system,compared the advanced experience of foreign countries,finally put forward to improve China's VAT deduction system.It is suggested that the China's VAT deduction system should follow the tax statutory principle and raise the level of legislation,in other words,its determination and adjustment should be carried out in accordance with the law in order to comply with the authority,justice,and stability of the law;It is suggested that the tax elements should reflect the principle of fair taxation,and realize the equitable distribution of VAT tax burden between different taxpayers,in other words,optimizing the tax rate structure,lowering tax rate and simplifying the tax rate;The system of identity conversion for small-scale taxpayers should be improved,so as to enhance the enthusiasm for the conversion of small-scale taxpayers' identities;VAT exemption items belong to tax avoidance measures,which are applicable to goods and services explicitly enumerated by the law and conducive to the realization of specific economic and social policy objectives;The Law needs establish a system of refunding and offsetting of the remaining deductible tax and the taxpayer,s value-added tax deduction right,taxpayers may choose to exercise the right to apply for the refund or offset of the remaining deductible tax,so as to realize fair distribution of tax burden and keep a balance between property rights of citizens and fiscal power of the state,finally achieve the equality of both parties' legal status.VAT deduction system is an important part of deepening the reform of the fiscal and taxation systems in our country,our country should keep pace with New Era to improve the current VAT deduction system,and establish just concise and effective VAT deduction system.
