Research On Fair Competition Censorship System

On June 1,2016,the State Council promulgated the Opinions on Establishing a Fair Competition Review System in the Construction of the Market System,which symbolized that the fair competition review system was established at the national level.The fair competition review system has made provisions in terms of its importance and urgency,general requirements and basic principles,the content of fair competition review system,implementation measures and safeguard measures.The establishment of a fair competition review system is conducive to accelerating the transformation of government functions,coordinating industrial policy and competition policy conflicts,and ensuring that markets play a decisive role in resource allocation.This paper,through the theoretical analysis of the fair competition review system,lays the foundation for the subsequent elaboration;analyzes the contents of the Opinions on Establishing a Fair Competition Review System in the Construction of the Market System,combines the problems of the fair competition review system,and uses the experience of foreign countries for reference to improve the system in China.Make recommendations to promote the development of a fair competition review system.This article has five chapters.The first chapter starts from the theory of the fair competition examination system,and determines the concept,legal characteristics,theoretical basis and significance of the theory,so as to seek a more comprehensive and concrete analysis of the fair competition review system.Chapter two comprehensively introduces the origin and content of the system by analyzing the content and historical evolution of the fair competition review system.The third chapter discusses the problems existing in the system from macro,micro and other aspects.Chapter 4 provides inspirations for China's fair competition review system by analyzing the differences between Australia's national competition policy,Korea's competition assessment system,Japan's competition assessment policy,and the EU's restrictions on state subsidies.The fifth chapter provides suggestions for perfecting our fair competition review system by drawing lessons from foreign experience and combining our national conditions.
