The Study On Flawed Warranty Liability Of Huatong Double Factoring Case

In the international factoring business,the common legal issues are the question of the exporter's flawed warranty liability and the fact that the factoring company pursues the exporter.Because the uniform legislation of international factoring does not contain any provisions on the liability of flaw guarantee,the law of other countries and regions about the flaw guarantee is usually applied in international factoring practice.I selected the case of the double factoring case of Huatong Company.Combining with the regulations and theories of each country on the liability of guarantee of defective flaws and the rules and theories of recourse of "General Rules of International Factoring",I analyzed the cases involved in the case Flaw warranty liability issues,and put forward their own opinions,and got some inspiration through the case.The main body of this essay includes following three parts:The first part is a brief introduction of the case and the legal issues involved.This part first introduces the double factoring case of Huatong Company,and then puts forward the questions about the warranty liability and the recourse issues involved in the case.The second part analyzes the problem of flaw guarantee responsibility.This part analyzes the flaw guarantee responsibility in the double factoring case of Huatong Company by combining the rules and theories of flaw guarantee responsibility in various countries,including how to identify the flaws in the case and the legal consequences caused by the flaw.The third part,the enlightenment of this case.This section presents the insights gained from analyzing the above issues,that is,how to avoid and solve these problems in practice.
