Study On Application Of Special Confiscation In Chinese Criminal Law

Special confiscation is the confiscation of illegal gains,contraband,and property that is used for crimes.Since its establishment,special confiscation has been playing its role in combating crime and maintaining social stability and harmony.However,with the development and progress of society,the drawbacks of the provisions of special confiscation are increasingly obvious in law,and have lagged behind reality.The legal circle still has not reached a consensus on the basic issues of special confiscation,such as the legal nature of special confiscation.In recent years,with the crackdown on official corruption,more and more cases involving special confiscation have been involved,and the value of the articles involved is increasing.Therefore,more and more attention has been paid to the study of special confiscation,which is of great significance to the study of special confiscation.In this paper,the basic problems of special confiscation,the object of confiscation and the problems existing in its application are mainly studied.This paper is divided into three parts.The first part mainly discusses the concept and legal nature of special confiscation,and puts forward my own opinions on the basis of the analysis of the theory of the nature of the special confiscation.The second part mainly discusses the object of special confiscation,and puts forward some feasible opinions on the standard of the object of special confiscation.The third part mainly discusses the applicable problems of special confiscation,and puts forward relevant solutions.
