Study On The Procuratorial Supervision Of Criminal Investigation Procedure In China

Investigation refers to specific investigation work and related compulsory measures conducted by the authorities when handling criminal cases.In any country,criminal law enforcement measures are inevitable in the process of discovering and combating crimes.And the exercise of public power is usually supported by all sorts of national resources,in which case is easily abused and violates personal rights it there is not appropriate and strict supervision,so corresponding remedies must be provided to guarantee the power of criminal law enforcement is rightfully exercised.In our country,the people's procuratorate is the national legal supervision organ specified in the Constitution and related laws,one of whose main duties is to prevent the power of criminal law enforcement being abused by organs of criminal investigation,so as to maximize the protection of private rights from the authorities in the process of fighting crimes and maintaining social order.The concept of investigation supervision studied in this paper only refers to procuratorial supervision of criminal investigation conducted by the public security bureau.This article includes three parts.The first part is an overview of the procuratorial supervision system of-criminal investigation conducted by investigation authorities,which mainly discusses the concept and connotation of procuratorial supervision of criminal investigation,and introduces its value in the criminal litigation procedure,and the methods commonly used in the current legislation.Second,to analyze the problems of procuratorial supervision of criminal investigation in our country from the aspects of legislation,the compulsory measure of arrest,and the supervision of investigation activities.Finally,the author has pointed out some practical suggestions for the improvement paths of procuratorial supervision system of criminal investigation in light of the experience of extraterritorial legislation.One is in the aspect of legislation,to build a new type of relationship of the people's procuratorate and the police in which the people's procuratorate plays a guiding role in investigation activities,and to improve the system of specific investigation supervision,strengthen the legal effect of...
