The owners' committee is set up as a way for owners to participate in the management of public affairs in their communities.But in fact,most of the owners' committees in China are in name only or die.Therefore,the study of how to improve the system of community owners' committee in China is conducive to finding contradictions in the legislation,and thus formulating relevant laws and regulations and creating a harmonious society.On the basis of studying the relevant documents of the domestic and foreign owners' committee system,this paper analyzes the main problems and causes of the community owner committee system in our country,and then puts forward the Countermeasures for the improvement of the community owner committee system by drawing on the legislative experience of the house owners committee system at home and abroad.This article is divided into four parts.The first part mainly expounds the system of residential property owners committee and the current situation of legislation in China.First,it introduces the concept and characteristics of the owners' committee,the relationship with the relevant organizations in the community,the theoretical basis and value of the owners' committee system.Then it introduces the general situation,main legislative status and main contents of the owners committee system.The second part mainly studies the problems and causes of the residential property owners committee system in China.First,the main problems of the community owners committee system in China are analyzed: the legal status of the community owners committee is not clear;the management system of the community owners committee is not sound;the operation procedures of the community owners committee are not standardized;the supervision mechanism of the community owners committee is not perfect.Then,the reasons for the problems are as follows: the laws and regulations are not perfect;the residents lack the awareness of the protection of the public rights and interests;the community owners committee is difficult to be established;the members of the community owners committee lack the corresponding benefits.The third part,through the study of the United States,Japan,the United Kingdom,Singapore and the Hongkong Special Administrative Region,Taiwan District owners committee system,from which to improve our community owners committee system is worth learning from.The fourth part is the countermeasures to improve the system of residential owners' committee in China.First of all,we should consider the guiding ideology,the legislative system,the basic principles and the relationship with the relevant organizations.Finally,it is concluded that the improvement measures of the community owners committee system are: to clarify the legal status of the community owners committee,to strengthen the government's guiding role on the work of the community owners' committee,to realize the full-time employment of the community owners committee,and to improve the supervision mechanism of the community owners' committee.
