With the fast development in China's economy and information technology,the third-party online payment is becoming the most important way of payment in daily life.When the third-party payment agencies expand their market and compete for customers,many legal problems on third-party payment are highlighted day by day,especially the distribution of liability in the third-party online payment.It has affected the development of the third-party online payment industry,and we need to improve relevant laws and regulations to solve such problems.As we all know,the third-party online payment was based on the network technology,so its currency form,payment form and information transmission instructions has changed,which brings a large number of network security risk,resulting in payment errors emerged in an endless stream and huge economic losses of customers.But in reality,the legal relationship between the parties in the third-party online payment is very complex,and the current legislation of our country is lack of definition of civil liability and the provisions of the current distribution.Therefore,in judicial practice,the contract of each participant is often used as the basis of judgment,which makes it difficult for ordinary users to truly safeguard their legitimate rights and interests.To solve the problem of liability distribution in the third-party online payment,we should first clarify the nature of the third-party online payment according to its characteristics.Secondly,improve relevant laws and regulations and civil special law to strengthen the norms.Finally,it is necessary to establish a multiple dispute resolution mechanism combined with litigation and non-litigation in order to ensure the fair solution to the problem of liability distribution in the third-party online payment security.
