The Influence Of Unclear Enforcement Basis On Civil Execution And Countermeasures

Executive basis is a valid legal document,which is made by a specific organization,indicating the ownership of rights and obligations,and a prerequisite for compulsory execution.However,in fact,although the implementation is based on a clear scope of the referee and the content of payment,it may also meet some problems because the existence of objective factors such as language ambiguity,unexplained explanation,and no executable,which leads to the possibility of failing enforcement,and therefore increases the cost of execution,and the rights and interests of the rights holders can't be realized,leading to a difficult situation.Therefore,this paper mainly studies the problem of "difficult situations" in the process of civil execution,which is specifically the on the influence of implementation system ?the judicial credibility? the rights and interests of the parties,also on the influence of letters and visits,and then analyzes the reasons for the unclear implementation,and puts forward practical solutions on this basis,so as to actively respond to concern of the implementation from the highest court.
