Marriage legal system is one of the more popular subject in ancient Chinese history research,especially is in transition from the feudal society of the tang and song dynasties,all aspects of social life are presented and the characteristics of different dynasties,and have far-reaching influence on later generations.Based on the existing literature,this paper will analyze the divorce system of song dynasty in this period,so as to study the internal relation between social political development and legal system change.This paper is divided into three chapters.First chapter,mainly introduces the social and historical background of the song dynasty,especially in the song dynasty legal system development,the song dynasty is in the history of Chinese commodity economy,culture,education,scientific innovation,highly prosperous era for the management of the population,control tax of marriage legal system also has a new progress in the legislation.Therefore,the divorce phenomenon in the song dynasty also produced new highlights and differences.This chapter will analyze the marriage of the song dynasty,the marriage of the scholar-officials,the divorce of the middle and lower marriage,and the reasons for the divorce.The second chapter,the paper introduces the system of divorce,the specific content of the song dynasty included allowing divorce case,the situation of legal divorce,remarry,marital property division,and children belong to the problem,and the divorce procedures.The third chapter,the social economy in song dynasty has a great improvement,the status of women more power also change,improve can be found in the song dynasty women's human rights promotion of women's rights is the foundation of song dynasty system of divorce.This section will focus on the song dynasty women rights in marriage,from the aspects of children,property,the influence of the ethics,pay attention to the song dynasty women at the time of divorce and remarriage of real rights and restrictions.In addition,it compared with the han dynasty,the tang dynastyand the Ming dynasty.In short,at the important stage of development of social history transition of song dynasty legal system has a high research value,this period of marriage and family law system,with its uniqueness,after the comprehensive analysis in depth,can present the whole picture of the song dynasty system of divorce,and special parts in the system of ancient China divorce them.
