Research On The Legalization Of Surrogacy In China

A new form of assisted reproduction,surrogacy,is being carried out in the modern society because of its ability to produce children's dreams for infertile women.But at present our country has yet to formulate relevant laws and administrative rules and regulations about surrogate,so in the actual judicial trial,because of the lack of relevant trial basis lead to damage to the parties rights without legal protection,it also caused the law should be legal for a surrogate system of fierce debate.Is not only the academic circles,with increasing phenomenon of infertility,the people of reproductive rights maintenance,prompted the underground "boom" development of surrogacy agency,but due to lack of restrictions on surrogacy agency,the rights of the people are easy to be hurt,so the legalization of surrogacy also become the hot topic which the people discuss and urgent requirements.With regard to this,this article will explain the legalization of surrogacy in three chapters:The first chapter is the question.Firstly,the surrogacy scene and the reason of the current "flourishing" development are analyzed in detail.In addition,the concept of surrogacy is defined and the different classification of surrogacy system is analyzed from different perspectives.At last,this paper expounds the predicament of the legalization of surrogacy in China,and analyzes it from the legal and social aspects respectively.The second chapter elaborates on the national legislation pattern of two different attitudes towards the legalization of surrogacy: one is to adopt the attitude of "limited openness" and "comprehensive openness" to the legalization of surrogacy;The other is explicitly banning surrogacy.The third chapter is to explain the attitude of surrogacy in China,and put forward relevant legislation.This chapter,the first to adopt different attitudes towards foreign countries legislation pattern analysis conclusion,then respectively from a surrogate shall follow the principle of the behavior,limited range,the rights and obligations,suggest legalization of surrogacy agency management,respectively.
