A Study On The Legal Prevention Of Bullying In Junior High School

Bullying behavior refers to happen on campus and its radiation area,a Fang Chan between students or more deliberately or malicious through body,language and network implementation methods such as bullying,insult,cause the other bodily injury,property damage or mental injury.This paper focuses on the legal prevention of bullying behavior in junior high school.Due to the limitation of the age of responsibility,the current law cannot be applied to most cases of bullying in middle school.As a result,most of the perpetrators of bullying at criminal levels should have been punished severely,but only to be brought back to education.The great contrast of the result has aroused heated discussion in all walks of life.At the same time,there are serious deficiencies in the implementation of non-penal corrective measures,the guardianship legislation of minors and the function of punishment in schools.Therefore,it is urgent to solve the problem of junior high school bullying.This article draws on domestic and foreign various areas in the prevention and management experience in junior high school campus bullying,in the thorough analysis factors affecting series for junior high school bullying behaviors as well as the various problems encountered in the process of governance,on the basis of put forward the corresponding solutions.The main contents are divided into the following five parts:The first part is the introduction,which focuses on the research background,research significance,literature review,innovation and deficiency of the school bullying in junior high school.The second part is an overview of school bullying in junior high school.It mainly defines the concept and summarizes the basic characteristics and classification of bullying behavior in junior middle schools in China.The third part mainly analyzes the main factors that affect the bullying behavior in junior middle school.The fourth part mainly analyzes the obstacles that our country encounters in the practice of preventing and managing the school bullying in junior high school.The fifth part mainly aims at our country junior high school campus bullying prevention,widely absorbs foreign and our country Hong Kong,Taiwan area the beneficial experience,from the introduction of "malicious complement age" rule,perfect "to teach punishment" non punishment and correcting measures,improve the legal system of our country minor guardianship and gives legal punishment power of school teachers and disciplinary power etc.Put forward the prevention and management of our country the legal countermeasures to junior high school bullying.
