The legal system reform in modern China is said to be completely “westernization”,and there are different voices in the process.Political reform at the end of Qing Dynasty claims that we should respect traditions,treat western culture with caution.Represented by Zhang Zhidong,National Conditions Faction is the major forces.National Conditions Faction claims that we should remain more traditions in the political reform,while Opposite National Conditions Faction claims that we should study more western culture.They had a drastic dispute over this issue through the beginning and the end of the political reform of the end of Qing Dynasty.National Conditions Faction insists that the legal reform should go under the premise of maintaining ethics laws,considering folk custom and situation.The process should go step by step and should be gentle.While Opposite National Conditions Faction insists that the legal reform should take the western law as the criterion,advocate statism.This paper studies the theory of National Conditions Faction,analyzes the time limitation of thought of National Conditions Faction,explores and analyzes the saving grace of the thought through analyzing the Argue of the Etiquette and Legal,and the lifetime of the representative of National Conditions Faction.Now,the socialism legal system of our country has completed,but juridical practice and legal text come apart.Actually,modernization must rely on the society and culture of our nation without losing yourselves.Law transplant is not just mechanically.This is to mean that there are many experiences in the Political reform of the End of Qing Dynasty for us to use for reference.The theory of National Conditions Faction is valuable to survey and discuss again.
