The Study On The Administrative Protection Of Intellectual Property Rights

As an important role of the “dual track” system,the administrative protection plays an important part in the protection of intellectual property rights.In recent years,With its many advantages,such as high efficiency,convenience and wide protection field,the administrative protection has become one of the important ways in the protection of intellectual property right.And this way of protection has made remarkable achievements.But from the present situation,the administrative protection is not perfect in the legal system,the law enforcement mechanism,the administrative relief system and so on.These realistic problems have hindered the further development of administrative protection.First of all,this paper starts with the basic theory of intellectual property rights administrative protection,and tries to analyze the value and feasibility of the administrative protection system of intellectual property by studying the legal basis and connotation of administrative protection.Secondly,through empirical research,the author analyzes the current situation of the administrative protection system of intellectual property in China,including the status quo of the institutional structure,the achievements,the existing problems and the reasons for the problems.Finally,based on the successful experience from other countries,the author offers some measures to improve the administrative protection of intellectual property from three aspects: the administrative protection legislation system,the enforcement mechanism and the relief system.And the author hopes to provide help to the improvement of the administrative protection system of intellectual property rights in China and promote the development of intellectual property in our country.
