Research On Design Patent Protection For GUI

The article starts with the eligibility of graphical user interface(GUI)which is protected by the design patent.It discusses the suitable conditions of GUI by design patent protection,and gets the conclusion that GUI can be protected by the design patent.Secondly,it discusses how to protect GUI by the design patent,analyzes the current disputes and difficulties in the protection of the GUI with the overall and partial design methods in the world.Finally,it discusses the GUI who are not protected by the design because of the functional condition.The rationality of the interface is analyzed,and how to distinguish between the functional and decorative nature of GUI and asks the question of whether or not the functional requirements of our country are reasonable.As a special design,GUI has been widely controversial in its protection.Only by clarifying the qualifications of design protection for GUI,clarifying the difficulties and controversies in the process of its protection,can it be better protected.
