The frequent transfer of funds from mobile payment accounts of other people continues to impact the limits of the criminal law system.However,the criminal law theory and judicial practice have therefore been caught in a difficult situation in the transfer of funds from other people's mobile payment accounts.Mobile banking payment is one of the forms of mobile payment.For the qualitative use of the transfer of funds in the accounts of another person's mobile bank account,it should first recognize that the mobile bank account has the connotation of “credit card” in the criminal law,and is also the expression form of credit card information.If an actor passes money through another person's mobile bank account and lands on mobile banking,it is in conformity with the fraudulent use of another person's credit card.The actor shall be deemed to be convicted of credit card fraud.For the qualitative analysis of theft of other people's mobile phones and the use of mobile banking funds to transfer accounts,the front and back behaviors should be evaluated separately.When the theft of the mobile phone meets the incrimination standard,the theft is determined by theft.The use of mobile bank transfer account funds should be determined as fraudulent use of other people's credit cards,constitute the crime of credit card fraud,and the combination of theft and use of behavior.Moreover,the crime of stealing a credit card and using it is arrogant and should be considered as the crime of credit card fraud.For the qualitative behavior of the actor's transfer of funds from other third-party mobile payment accounts,due to the binding relationship between the third-party mobile payment account and the credit card account,it should also be recognized that the third-party mobile payment account has the attributes of a credit card account.The act of transferring money from a third-party mobile payment account of another person is essentially a fraudulent use of a third-party mobile payment account of another person,that is,fraudulent use of another person's credit card.Whether or not the third-party mobile payment software program can be deceived is actually a question of whether the machine can be deceived.The third-party mobile payment software program has an identification and authentication function,and therefore has similar human brain discrimination ability.As a result,the third party mobile payment software program can be deceived.Therefore,the use of other third party mobilepayment account and transfer of funds in the account should be regarded as the crime of credit card fraud.
