The Regulation Of Malicious Objection To Trademarks In Our Country

Trademark malicious objection is a special phenomenon in trademark dissension,which is the behavior of trademark malicious dissenter using the law loophole of trademark objection procedure.A malicious objection to a trademark should be defined in the first place.This paper defines the trademark malicious objection from the main body,subjective aspect and objective behavior: a natural person,a legal person or any other organization shall,knowing that there is no legitimate reason,still raise a trademark objection to prevent the registration of another person's trademark.On the basis of referring to the trademark malicious objection regulation model in the world,this paper discusses the trademark malicious objection regulation mode suitable for China's national conditions.After giving the definition of trademark malicious objection,this paper puts forward seven specific problems in the existence of Chinese trademark malicious objection,and then probes into the mode of the malicious objection of the regulation trademark.The trademark malicious objection mode is the answer to the three choice questions : Comprehensive review and partial review,the three kinds of combination of objection subject and reason of objection and the objection is preceded by an objection.On the basis of referring to the trademark malicious objection regulation model in the world,this paper discusses the trademark malicious objection regulation mode suitable for China's national conditions.Malicious trademark objection regulation mode is a regulation of malicious trademark objection "skeleton".Under this "skeleton",this paper puts forward corresponding suggestions on the seven problems.
