Research On The Influence Of Network Public Opinion On Judicature

The development of network media is having a profound impact on people’s lives,now is entering a new era of "Internet plus",and the rise of the network public opinion is a neglected emerging in the trend of the times.To some extent,the judiciary is only loyal to the abstract legal provisions and principles.However,judicial activities are limited by specific time and space conditions.Various social factors,including Internet public opinion,may have a certain impact on judicature,especially on court trial.On the one hand,the network of public opinion has prompted some cases result in a fair judgment,on the other hand,judicial independence,the development of the network of public opinion affect the judicial independence,judicial power how to deal with the network public opinion has become the current issue,and this is also the author of the thesis wants to discuss.The author mainly through in-depth analysis of three typical cases to explore the influence of the network public opinion of the judicial performance in three cases,combined with the theoretical research and practice of the latest to prudential thinking,in order to seek the way to solve the current tension of network public opinion and judicial.This article is divided into four chapters,the first chapter is the introduction,focusing on the background and significance of the topic,the domestic and foreign research review,the research ideas and objectives.The second chapter is the reason by the influence of the network public opinion of the judicial.Firstly defines the two concepts of the network public opinion and judicial,to clarify the meaning and extension of the concept of the convenient discussion,analyze the reasons from the four aspects of " Internet plus " era,Internet consciousness,legal belief and legal principles of justice by the influence of the network public opinion.The third chapter analyzes the influence of the network public opinion from the perspective of judicial case,Peng Yu case,Yan Xiaotian case and Jia Jinglong case of three specific network public opinion affect the judicial case.To further explore the influence of network public opinion on judicial justice,in the face of the network public opinion on the positive influence at the same time,the need for further reflections on non benign influence,which is a point I want to discuss.The fourth chapter explores the network public opinion on judicial path positive influence to promote.Through the above analysis,the author thinks that we can draw the following four conclusions,namely the improvement of legislation and judicial system to absorb public opinion collection system to respond to network public opinion.Clear network legal dimension,set a reasonable standard of network media,correctly guide the network public opinion.Strengthen the judicial transparency,argumentation with network technology and consciously accept the supervision.Strengthen the legal system publicity,improve the public knowing and understanding the concept of law-abiding,maintenance of the four dimensions of harmonious society put forward tentative suggestions,in order to alleviate the legitimate non benign influence of the current network of public opinion on justice,so as to promote the orderly operation of justice.
