Analysis On The Development Of Chinese Lawyer's Rights Protection System And Development

The development of the world's lawyer system has been over 2300 years,however the history of China's lawyers system has been just a little more than a hundred years old.The Lawyers Law of the People's Republic of China,The Criminal Procedure Law,The Civil Procedure Law and The Administrative Procedure Law of the People's Republic of China have the content of protecting the lawyers' rights of practice,however,some provisions are not clear enough,or even conflict with each other.The Law,as an important area of Jurisprudence,has not received enough attention.At the same time,the relevant theoretical system has not been systematically formed.Whether the legal rights of the lawyer can be guaranteed,whether the legal rights and interests of the parties concerned can be maintained,and whether the judicial system is fair and just.As a matter of fact,with the growing demand for legal services,the protection of lawyers' practice right should go hand in hand with such needs.The reform of the Lawyer System started,while.The fourth plenary session of the 18 th CPC central committee put forward the general goal of comprehensively advancing the rule of law.In2015,China issued "The provisions on the protection of the practice rights of lawyers according to law",which has epoch-making significance for the protection of Chinese lawyers' practice rights.To better analyze the current situation of Chinese lawyer's practice rights,the article find out the difficulties and development direction of the lawyer's right of practise the right of lawyer by analyzing the status quo of the practice rights of lawyers in the Zhongshan city.Experience more than two years of data collecting and comparative analyzing,more than 300 questionnaires were answered by Zhongshan lawyers.By analyzing the questionnaires which contained questions about lawyer's need to protect their own practice rights,the cognitive degree of the Zhongshan lawyer right protection method,whether the practice right is guaranteed and opinions of the legal professional community and so on.,the implementation of the protection of Zhongshan lawyers' practice rights in recent years are combined with.In the end,the article put forward improved opinions and suggestions on the existing problems based on the actual situation of our country,so as to provide a reference for the development of Chinese lawyers' rights protection.
