The Study On Surrogate Country System Of European Union's Anti-dumping Law

In recent years,China's foreign trade has been developing rapidly.Meanwhile,China has been suffering from increasing anti-dumping investigations.During European Union's anti-dumping investigation against China,European Union regards China as non-market economy country and applies surrogate country rule by using the price of the same products or the similar products of one market economy country to calculate the normal value of products exported from China.Such anti-dumping practice from European Union has resulted in damage to China's relevant industries,restriction on China's foreign trade and infringement on the rights and interests of China.Basing on the new situation of the expiration of the paragraph 15 of the Protocol of China's Accession to World Trade Organization since 11 December of 2016,the proposal from European Commission on the amendment draft on European Union's Anti-dumping Law and the approval on its Anti-dumping new rules by European Parliament on 15 November of 2017,this thesis aims to learn European Union's current legislation on surrogate country rule during anti-dumping practice against China and its legal basis from international law level,study the new rules on European Union's Anti-dumping Law,analyze the development trend of the surrogate country rule of European Union's Anti-dumping Law,and then propose the strategy should be taken by China in order to protect the rights and interests of China and Chinese enterprises by applying for the correction and the explanation on Anti-dumping Agreement of World Trade Organization and applying for market economy treatment through the dispute settlement mechanism of World Trade Organizations.
