Research On Criminal Prosecution Of Environmental Crime In The U.S. And Its Enlightenment

With the rapid economic growth in the past decades,the problems of environmental pollution and the decline in ecological quality have become more serious in China.Haze problem,water pollution and soil poison have seriously affected the daily life of our ordinary people.Under this background,this article seeks to suggestions for our comprehensive ecological improvement by studying the environmental criminal enforcement in the U.S.Divided into four main sections,the first is an introduction,discussing the background and significance of this topic,the current research situation,the research methods and innovation.The second chapter introduces the history of the federal environmental crimes program including changes in the criminal law enforcement and establishment of specialized agencies.The purposes of this chapter is for readers to realize its criminal policy and form overall understanding of American environmental crime prosecution.The third chapter based on the second one,provides a detailed analysis of criminal investigation and prosecution procedure of environmental crime in the U.S.This section tries to distinguish the differences between the common street crime and environmental crime in purposes,objects,investigation process and evidence gathering,also emphasizes the complexity and comprehensiveness of the environmental crime.Actually,the last chapter is a conclusion,by analyzing the current situation and problems of China's criminal law enforcement in environment to put forward some special suggestions for our country.The subject of responsibility should be added to.Also the environmental protection department should have the right for criminal investigation and prosecution in order to play its role.At the same time,improving the specialization of environmental justice and self-audit of enterprises are conducive to achieve the dream of "beautiful China".
