The people's Court of Zhejiang Province,which is the first to borrow the platform of the Taobao network,is the judicial auction.After the court achieved some success,more and more social groups and legal talents began to pay attention to the application of judicial auction online.Generally,when people come into contact with new things,they always hold a skeptical attitude.Now the online judicial auction has just arisen,and many scholars have questioned the feasibility of its use.The court did not want to deal with is the disposal of assets,in the continuous development of the times,the simple use of the traditional auction auction has been unable to meet the needs of the court,so there is an urgent need to reform the judicial auction.Now is the information age,network technology developed,the use of network judicial auction way is an inevitable trend.Along with the judicial auction being used by related courts,there are many legal problems in the practice of online judicial auction.In this context,it is necessary to explore the existing problems of network judicial auction,and to improve the relevant system recommendations.This paper through the network judicial auction of necessity and practical significance,in view of the actual problems existing in China's judicial auction network,put forward their own ideas,to explore the advance of China's network judicial auction system strategy.The main contents of this paper are as follows:The first chapter mainly expounds the background,concept and nature of China's online judicial auction.On this basis,the existing three types of network judicial auction: Zhejiang model,Chongqing model,Shanghai model.On the one hand,it compares the three modes of Zhejiang,Chongqing and Shanghai,on the other hand,compares the judicial auction with the traditional judicial auction,and then expounds the advantages of using the network judicial auction.The second chapter mainly discusses the existence of networks using loopholes in the judicial auction,further analysis of China's judicial auction network system has some defects,and easy to appear in the practical application of the safety problem.The third chapter mainly aims at the problems existing in the network judicial auction in our country,and puts forward the solution.The main ideas and suggestions include: the first step is to formulate relevant supporting network judicial auction law;the second is the legal relationship specification of existing network judicial auction;finally,should improve the network security index network judicial auction.Through the reform and transformation of the specific mode of operation of the traditional civil litigation,will produce a network judicial auction,online auction of justice can not only maximize the execution property of the premium rate,but also on the related rights of litigant protection.Therefore,the network judicial auction not only solves the relevant social disputes to a certain extent,but also provides the basis for building a harmonious society in all aspects.
