With the improvement of people's living standard,the demand for health is also increasing.However,due to the unreasonable allocation of medical resources in China,the excessive concentration of quality medical resources in some big cities has become increasingly prominent.In order to improve the situation,to better achieve high quality medical resources sink,in recent years,the national policy vigorously support the development of Internet medical,social capital has poured into the medical services,the Internet appeared online,online registration,remote medical consultation and so on many Internet medical service pattern.Appeared in the process of practice,such as the Internet medical service platform for the good and bad are intermingled,the doctor qualification confirmation,the problem such as infringing intellectual property rights in,with the popularization and development of Internet medical model,will necessarily appear more legal problems,for the healthy and orderly development of medical Internet can,need to comb and analysis on the legal issues of Internet medical.At present our country medical has not yet issued special laws and regulations for the Internet to carry on the specification,the domestic scholars on Internet medical research has mostly focused on the management supervision,civil liability,and not on the Internet possible operation pattern and the medical civil legal issues have a systematically discussed in this paper.In order to solve the Internet in the medical civil subject qualification confirmation,the classification of civil legal relationship,civil liability cognizance and bear the way and the Internet medical service contract concluded,contents and effectiveness,and so on,based on the Internet at home and abroad medical model,relevant laws and regulations of legislation and judicial practice,the existing Internet medical model and the possible "Internet hospital" made a systematic analysis of the civil law issues.The full text is divided into four parts.The first chapter on the concept,business types and development of medical Internet demonstrates a basic situation,at the same time,combining with the characteristics of the Internet,put forward the Internet medical problems in some of the civil law.The second chapter,the combination of Internet medical model for Internet medical institutions of medical treatment,doctors,patients,Internet equipment and technology providers and legal status of civil subject qualifications as well as their respective rights and obligations are analyzed and discussed.Existing in the third chapter of Internet medical civil legal relationship types are analyzed,and on the Internet from the establishment of medical service contract,effectiveness,content,implementation to the alteration,transfer and termination of combined with the existing laws and regulations are analyzed and expounded.The forth chapter,medical treatment because of the addition of the network technology of the Internet lead to the civil legal liability of acknowledgment and bear the way of change are analyzed,and puts forward the solution of the existing laws and regulations in our country.
