Research On Sealing Off System Of Juvenile Criminal Records

Minors are given the future and hope of a country.Special protection for minors is a common obligation of the judiciary and the whole society.However,if juvenile delinquency is recorded,it will bring negative evaluation to them,which is not conducive to their reintegration into social groups,and their rights will also be limited.Nowadays,many countries in the world have made the corresponding regulations on the seal of the record of juvenile delinquency,some in the way of legislation and some by non legislative.In 2012,China revised the criminal procedure law.It formally wrote the juvenile criminal record archiving system into the procedural law,which conformed to our criminal legislation policy and played a weightlifting role in protecting minors.At present,the implementation of this system in China for nearly five years,from the legal and social effects,there is substantial accomplishments,but from the ideal state of reality,also has some gaps,and other aspects of the conflict of law,procedure,supervision system,has not been properly resolved,this on the system will still bring some difficulties.The main purpose of this paper is to understand the system of juvenile crime recording and archiving,and to summarize and compare the provisions of the system in foreign countries,and then analyze the problems faced by China's current implementation of the system,and put forward corresponding suggestions for improvement.In the length of the article,this article mainly includes four chapters.The first chapter mainly analyzes the outline of the juvenile crime record storage system,analyzes and understands its connotation,and explores the significance of our system to this system.The second chapter adopts comparative writing techniques to explain the relevant provisions of juvenile crime record archiving in Germany,France and Russia,and find out the similarities and differences between those countries in legislation,so as to provide references for the improvement of our system.The third chapter is to find out the difficulties and practical problems in the implementation of the system of juvenile delinquency records in our country.And then in the fourth chapter,we put forward the corresponding suggestions from five aspects in order to promote the perfection of the system.
