Research On The Problem Of The Presumption Of Marital Common Debts

The purpose of this paper is to explore the identification system of matrimonial community debt.Based on the existing recognition rules,this paper analyzes the problems existing in the identification of the matrimonial community debt.That is to discuss the scope of the matrimonial community debt,the reasonable allocation of proof and the construction of the agency of family affairs.Chapter 1 introduces the concept of the matrimonial community debt,the nature of the matrimonial community debt,the theoretical basis of the matrimonial community debt and the relevant laws and regulations of our country.Chapter 2 mainly points out the problems existing in the legislation and judicial level.Chapter 3 introduces the common debt system of the four countries and the Hong Kong,Macao and Taiwan regions,and extracts the parts which can be used for reference in China.Chapter 4 In view of the existing problems in matrimonial community debt,the author proposes the personal suggestions to perfect the rules for the determination of the matrimonial community debt.
