An Empirical Study On Crime Of Infringement Of Citizen's Personal Information

Nowadays,the personal information of the citizens has become an important resource,and has potential commercial value.It is very easy to be leaked and even cause serious violent crime.This paper mainly uses empirical analysis to referee network in China in the past five years the open verdict as samples,through a large number of data analysis of this kind of crime quantity,crime location,subject of crime,crime,criminal discretion of the status,research on the characteristics and preventive measures.This article is not only a study of the constitution of crime,nor a mere theoretical study,but a violation of the status of citizens' personal information crime in judicial practice through the verdict analysis,and based on the individual,society and state as the starting point to analyze why such crimes are so rampant.It belongs to the category of legal sociology.Based on the data analysis of court decisions in recent five years,this paper summarizes the characteristics of the crime of infringing citizens' personal information: the number of such crimes is large,and the crime places are mostly concentrated in the economically developed areas.Occupation of the subject of the crime and diversification for recidivists,a higher proportion of gang crime,unit crime subject in more specific.In the aspect of criminal behavior,the way to obtain information is mostly the way of purchase,and the use of information is diverse.In terms of punishment,the penalty is slow and the penalty is lower.On this basis,the reasons for frequent occurrence of citizen's personal information crime are concluded:first,case investigation is difficult;the two is slow punishment;the three is the absence of government regulation,and the lack of industry self-discipline;four,personal awareness of prevention is weak.Finally,this paper puts forward several suggestions for effective prevention of infringement on citizens' personal information crime: first,improving the efficiency of handling cases;second,strengthening penalties;third,strengthening government regulation and industry self-discipline;and fourth,enhancing citizens' personal awareness of prevention.
