As a kind of new network transaction mode,social platform private purchasing has the characteristics of the times and the particularity.Social platform private purchasing and specialized e-commerce platform for online shopping,the two platforms are different,different sales,dispute settlement mechanism,of course,there should be some differences.Social platform private purchasing and private entities shop also exist different.The new "consumer protection law" provides unconditional return right,to provide consumers with a new right-the right to go back.From the legislative point of view of the concept,the social platform for private purchasing should belong to the operator,but the existing legislation and there is no special provisions for this,there are some difficulties in practical use.The private purchasing person into the scope of the operator,the legal attributes of purchasing activities are defined as network activities.According to the existing legal interpretation,purchasing goods do not belong to the set of consumers,purchasing of goods has not ruled out in the "consumer protection law" article twenty-fifth scope of application.In addition,the "once sold without return" clause should be used reasonably.In order to improve the supervision of private purchasing behavior on social networking platform,the author believes that the primary solution is the determination of the private purchasing agent.The second is the consumer public interest litigation,private purchasing social platform is expanding,there must be large,victims are not specific,small dispersion of these damages lawsuit,at this time,the social platform should be included in the scope of purchasing private litigation.
