On The Determination Of The Value Of Family Labor Service In China

In our country,the realization of the value of husband and wife labor in real life has been inadequate,though,China’s "marriage law" the provisions of article 40 reflects the recognition of housework to a certain extent,but limited to the agreed property system,the regulation is too narrow,resulting in real life the main housework labor party in most rights cannot get relief,after the divorce he can’t get due compensation,living in trouble phenomenon occurred frequently.Based on these problems,the author through to research of the present situation of our family of husband and wife work,analyze our country husband and wife family labor value in the identified problems,put forward some improvement opinions.The article mainly studies the following:In the first chapter,it is divided into four parts: research origin,case introduction and topic definition,foreign labor value related to the introduction of legislation,domestic and foreign research status and research methods and content of four parts;The second chapter is the theoretical basis of the value of husband and wife labor,divided into the theoretical basis of labor value,the role of marriage law on the value of domestic labor,the traditional family concept of domestic labor value and summary of four parts;The third chapter is about the present situation and the dilemma of the determination of the value of domestic labor in China are divided into the status quo of the value of household labor in China,my opinion on the solution to the problem of focus,the comparison of the value of domestic labor and the idea of foreign legislation,the dilemma and summary of the household labor value in our country.The fourth part of the countermeasure of the value of husband and wife labor in China is divided into the marriage labor law and the compensation in the marriage law,the establishment of household labor and intangible property value recognition system,respecting the law of value and making the evaluation system of household labor value,expand the scope of household labor compensation mechanism Four parts.In short,I hope that the results of this study can provide some reference for the related issues of the value of family labor service in our country and promote the further development of the balance between men and women in our country.
