The doctor-patient relationship,as the most basic interpersonal relationship in med ical treatment process,is not only the interactivity between doctors and patients,but a lso the interaction between social groups and individuals closely linked to the interests of both parties.Since patient is an important party in this relationship,safeguarding t heir rights become increasingly significant.In this regard,through applying methods of literature study,comparative study,analytical induction and others,while combining the realistic domestic condition with the relatively developed patients' rights and obligations system abroad,this paper proposed to establish a legal system to safeguard patient rights by formulating Patient Rights Protection Act,clarifying the legal contents concern the encroachment of patient rights and interests,and improving their right relief mechanism.The argument of this paper has four parts.Part 1: the connotation definition of patient rights from three aspects: the background of domestic doctor-patient relationship,the conceptual understanding of patient rights,and the brief introduction of patient rights at home and abroad.Part 2: on consideration of the actual condition in china,choose and analyze typical cases of patient's informed consent and privacy rights that are most vulnerable and widelyconcerned,and briefly analyze the status quo of their principal rights correspondingly.Part 3: in-detail problem analysis of patient's legal rights protection from three aspects: patient rights legislation,civil legal liability and relief channel.Part 4: so as to settle the issues of patient's legal rights protection,targeted solutions are proposed from 3 aspects: building a unified patient rights legislation,clearing up legal liabilities in doctor-patient relationship,improving patient's relief mechanism.
