The Research On The Legal Issues Of Loan Guarantee Of Local Government Financing Platforms

The local government financing platform is the product of local government investment and financing innovation,which has made an important contribution to easing the adverse impact of the international financial crisis on China's economy and accelerating the urbanization process.However,due to the particularity of its identity,the original loan guarantee left a lot of legal risk problems.The guarantee method adopted by the financing platform in its self-financing loans to Banks and other financial institutions is more formalism.Actual bank guarantee claims are difficult to achieve.With the debt default of local financing platforms,the safety of loan capital has become the focus of bank supervision.Based on the case,this paper analyzes the legal problems existing in the three forms of guarantee.This paper explores the reasons for its formation,and puts forward relevant Suggestions for improving the legal regulation of loan guarantee of local government financing platforms.We will deepen reform of the fiscal and taxation systems to boost local finances and reduce the pressure on financing platforms to lend money.Try to formulate special rules for local government financing platform loans and regulate the subject behavior from the system.We will establish a risk supervision system for local government financing platforms and guard against the occurrence of various risks.This system is also the supporting mechanism of loan guarantee system.
