The original purpose of the establishment of the crime of medical malpractice is to protect the legitimate rights and interests of patients and maintain the working order of medical institutions.There are more than 30,000 cases of medical disputes in the period of time.So many cases of medical disputes and so few cases of medical malpractice crime show that in judicial practice,the nunber of medical malpractice crimes is large and the rate of invisible criminal reconciliation is high.Based on the comparison of the data obtained from the online judgment documents of China,this paper draws the question of the generalization of implicit criminal reconciliation of medical malpractice in our country.This paper analyzes the application of medical malpractice crime in China by empirical analysis,points out the harm of recessive criminal reconciliation of medical malpractice crime and analyzes its causes,and further clarifies the value of criminal reconciliation of medical malpractice crime through the comparison of specific cases.Finally,citing relevant real cases and combining with the above empirical analysis and the causes of generalized implicit criminal reconciliation,this paper discusses the countermeasures to solve the problem by turning the recessive criminal reconciliation of medical malpractice into a dominant goal.
