A Study Of Expert Assistant System From A Practical Perpective Of Civil Litigation

With the rapid development of economy and society,more and more specialized problems emerged which largely exceed the knowledge of judges,agents and litigation parties.These specialized problems are pivotal to the fact finders—it is important for the judges to find the truth,for the litigating parties to decide their perspective rights and liabilities,and for the agents to adopt valid litigation strategies.The 2013 revised Code of Civil Procedure establishes the Expert Assistant System,which is based on the Expert Witness System of common law,and our countries' authentication system as well as current legal professional status.Professional parties,however,are not familiar with its foundation,sources and contents of this new system.This article intends to introduce this new system by 1)chapter 1 and 2:a brief introduction of this system,including its contents,theories,and legislation intent;2)chapter 3:introduction of practical progress of this system;3)chapter 4:discussion of problems and issues of this system;4)chapter 5:consolidating regional guidance letters on this system;5)chapter 6:case study of 360 vs.Tencent;and 6)chapter 7:providing suggestions to improve this system.
