A Comparative Analysis Of International Export Control Systems And Research On Improving Related Legislation Of China

Export control is closely related to country politics,military,economy,natural resources and nuclear safety.It's a significant move to maintain national security,combat terrorism and violence,protect strategic resources,fulfill the international obligations.At present,many countries have enacted export control laws and regulations.China has several administrative regulations and department regulations,but they're not yet come to the legal level,and relatively scattered,incomplete,resulting in many practical problems.Nowadays,many security risks,especially the situation of anti-terrorism,are complicated and tough.The risk of proliferation of weapons of mass destruction,conventional weapons and related dual-use items and technologies is increasing worldwide.Meanwhile,with the rapid rise of China's political and economic forces,China is required to play its due role in the maintenance of international peace and security.China promulgated "The National Security Law",which gives "national security" new contents.National economic security is becoming more and more important.Under this new requirement,how to improve our export control legal system has become an urgent problem.By studying the international rules and the export control system of major countries and regions,this paper makes an in-depth analysis of the current situation of China's export control legislation,combines the relevant theories and practices of China's export control system,finds out the problems existing in China's export control system,and draws lessons from foreign practices and experiences.It puts forward suggestions for China to improve the legal system of export control.This paper is divided into four parts.The first part elaborates the basic theory and international rules of export control,mainly introduces the emergence and development of export control system,and analyzes the purpose of export control,the relation with national security,the impact on trade,as well as the international mechanisms and rules of export control.The second part makes a comparative analysis of the export control legislation mode,regulatory system reform of major countries and regions.The third part introduces the legal history and current situation of China's export control policy,introduces the legal system of China's export control,the specific system of China's export control,and analyzes the existing problems in China's export control legislation.The fourth part points out the necessity and basic principles of enacting the Export Control Law,and puts forward some suggestions on improving China's export control legal system.With the introduction and analysis,we come to the conclusion that it is necessary to amend and improve China's export control legal system,elevate the export control standards and levels,which is not only the need to safeguard China's national security,but also the need to fulfill the international responsibilities and obligations of major trading countries.
