Research On Improving Fault-tolerance Mechanism In The Field Of Government Governance From The Perspective Of Law

Since the 18 th National Congress of the Communist Party of China,the reform in China has been advancing in depth,and the anti-corruption struggle has been continuously carried out in China and achieved remarkable results.But at the same time,there are also some disharmonious phenomena in the domestic political ecology,that is,the negative behavior of omission,laziness and idleness.Against this background,Report on the Work of the Government 2016 first proposed the establishment of a fault tolerance mechanism.Through the analysis of the relevant practice and theoretical literature at home and abroad,this paper finds that the fault-tolerant mechanism is still a new research topic and in the early stage of the formation of the system,and the domestic exploration and research shows the characteristics of political practice preceding and being more richer than theoretical research.From the actual situation,however,there are the following problems in the practical exploration of the fault-tolerant mechanism: first,at the legislative level,there is a lack of unified fault-tolerant mechanism and normative legal documents;second,the diversity of text elements reflects the lack of rule of law in practice;third,the practice of fault-tolerant mechanism exploration is not open enough;fourth,it’s difficult to measure the effect of practical application of fault-tolerant mechanism through technology.In short,the domestic fault-tolerant mechanism is still inadequate in terms of institutionalization and legalization,and thus faces many difficulties.Fault-tolerant mechanism is a kind of security system with incentive nature.The theory of bounded rationality and public service motivation etc provides theoretical support for its exploration and establishment.To promoting the construction and perfection of fault-tolerant mechanism within the legalization-oriented under the background of law-based governance of the country,law-based administration of government and strictness in Party discipline,it is the deserved meaning of building a country ruled by law and a government ruled by law,and it is also the unique way to control and avoid the possible risks brought about by the application of fault-tolerant mechanism.Therefore,this paper attempts to analyze the theories and practice of the fault-tolerant mechanism from the perspective of the rule of law and on the basis of the reform of the supervision system in China,and put forward some suggestions for the further scientific improvement of the current fault-tolerant mechanism.This paper will start from four aspects: firstly,it will discuss the background and significance of the topic,summarize the research results of the fault-tolerant mechanismat this stage,and point out the further research that can be carried out.Secondly,it will differentiate the connotation of the fault-tolerant mechanism and related concepts,and demonstrate the value of the fault-tolerant mechanism and the necessity of legalization from the theory of bounded rationality and rule of law etc.The third part attempts to analyze the practical exploration of the fault-tolerant mechanism,and summarize the challenges that the fault-tolerant mechanism faced in practice.Finally,on the basis of the previous article,it establishes the basic principles that the fault-tolerant mechanism should adhere to,and proposes corresponding countermeasures for the improvement of the fault-tolerant mechanism.
