| People eat food for the day,and the degree of food safety is not only related to human health,but also closely related to social stability and economic development.However,in recent years,China's food safety crimes have been frequent,food safety is difficult to protect,infringe on the people's right to life and health,triggering a social public security crisis,hindering the development of the country and society,and becoming a difficult problem to be solved.Although China attaches great importance to food safety issues,it has formulated a series of laws and regulations to crack down on food safety crimes.However,in real life,food safety crimes have been repeatedly banned.This reflects that China's criminal law on food safety is not strict,and the penalty system needs to be improved.The specific performance is as follows: the penalty is not set properly,the amount of fines has no upper and lower limits,and the standard of fines for natural persons and units is not separately distinguished;there is no qualification penalty for prohibiting practice;there is no effective mechanism for execution of punishment,and the food safety law network is not strict.This article is based on the prevention of food safety crimes,and the selection of penalties is set as the entry.Based on the related concepts and characteristics of food safety criminal punishment,combined with the problems existing in the criminal law of food crime in China,the reasons for repeated violations of food safety crimes were discussed in detail,and personal opinions on how to prevent food safety crimes in China were put forward.Starting from the strict and not strict concept of criminal law,reasonable set up fines and additional qualifications,strengthen the effective connection between the Criminal Law and the Food Safety Law,and give full play to their effectiveness.Multi-level and multi-angle regulation of food safety crimes,establish a food safety penalty setting standard in line with China's national conditions. |
