Research On Several Issues Concerning The Application Of The Summary Procedure Of Criminal Proceedings

Compared with ordinary procedure,criminal summary procedure has the characteristics of simplicity and rapidity,and can save judicial costs and improve the efficiency of handling cases,so it is favored by all countries.China's Criminal Procedure Law in 1996 formally made relevant provisions on the application of summary procedure.In 2012,it was amended to expand the scope of application of summary procedure.At the same time,the procuratorial organs also made new requirements,requiring that the procuratorial organs must send prosecutors to debate in court.At this stage,in the procuratorial practice,the application of criminal summary procedure to deal with criminal cases has become an important choice for the procuratorial organs,but also to solve some cases effectively and qualitatively.However,the procuratorial organs still face many bottlenecks in the application of criminal summary procedure,which is a great challenge to the procuratorial organs.To this end,the procuratorial organs should make a positive response,explore the internal working mechanism at the same time with the public security organs,judicial organs to coordinate and cooperate in order to achieve a reasonable allocation of judicial resources to improve the rate of handling cases.Starting from the domestic legislative dynamics and judicial dynamics,this paper points out some shortcomings of the current procuratorial organs applying simple procedures,analyzes the causes of defects,and puts forward the author's vision of the procuratorial organs'working mechanism.Committed to improving the applicability of summary procedures in criminal cases and saving judicial resources...
