As one of the key research projects in the field of international child welfare and child protection,child abuse has attracted the attention of more and more countries and regions,and our country is no exception.However,the incidence of child abuse in recent years has had a bad impact on the physical and mental health of children.In the criminal law of our country,child abuse is usually criminalized and punished by the crimes of abuse,mistreatment of the ward and the crime of intentional injury.To a certain extent,the children's legal rights and interests are protected,but there are also cases where the threshold of conviction is higher and the penalty is lighter.In order to better protect the rights and interests of children,it is very important to explore the way of criminal law regulation of child abuse by studying the National conditions of our country and drawing on foreign experience.This paper selects four typical cases in the past three years,and considers the shortcomings of the current criminal law on the regulation of child abuse in our country.In the judicial practice of our country,the typical crimes related to child abuse include the crime of abuse,the crime of intentional injury,and the crime of maltreatment of the ward.By analyzing the relationship between child abuse and each crime and the relationship between the three crimes,the boundary between sin and non-sin,this crime and the other crime is clarified.Through studying the content of the criminal law regulation on child abuse in the United States,the United Kingdom,Germany,Japan and other countries,based on the actual situation of our country,we reach the conclusion of this article.That is,the exploration of the way of criminal law regulation of child abuse.Reducing the threshold for criminalization in terms of the composition of the offence;In terms of penalties,increase the severity of penalties;In the crime of abuse,change the crime of prosecution.Better protect the legitimate rights and interests of children.
