Research On Copyright Law Protection Of Variety Show Mode

With the development of the economy,people's demand for spiritual culture is getting higher and higher.Domestic variety shows have not met the needs of the masses.Some TV stations or satellite televisions have introduced excellent variety show modes from abroad to win market position.When the modes of international excellent variety shows are introduced,there is a wind of plagiarism and imitation in China.As a result of domestic copying from foreign countries and mutual copying between domestic,the number of homogeneous shows is increasing,and relevant infringement is becoming increasingly fierce.Due to the lack of clear provisions on the legal protection of TV variety show modes in China,it is difficult for infringement disputes of TV variety show modes to be effectively solved.This paper starts from the reality,combines the domestic and foreign related practice and the typical cases,carries on the research on copyright law protection question of the variety show mode.This paper believes that variety show mode belongs to the intellectual achievements in the field of science of literature and art,with originality and replication,conforms to the components of the work.In order to effectively solve the problem of variety show mode of legal protection,earnestly safeguard the legitimate rights and interests of various parties involved in,variety show mode should be included in the scope of the protection of the copyright law to perfect copyright law as soon as possible.In addition to the introduction and conclusion,this paper is divided into four parts: the first part is the overview of variety show mode.In this part,the concept of variety show mode is clarified and comparatively analyzed with relevant concepts.And then,the practical significance of legal protection of variety show mode is explained,which lays a foundation for further discussion in the following parts.The second part mainly analyzes and compares the protection methods of foreign countries for the variety show mode,from which we can learn the valuable experience.Combined with the actual situation of our country,we can explore the best way to protect the variety show mode of our country.The third part mainly discusses the current situation and difficulties of the legal protection of China's variety show mode from the aspects of legislation,judiciary and administrative law enforcement,in order to find the crux of the problem and solve the existing problems in the legal protection of China's variety show mode.The fourth part deeply discusses the feasibility ofcopyright law protection of Chinese variety show mode.This part clarifies the nature of the variety show mode works,and suggests that variety show mode be included in the scope of copyright law protection,finally further puts forward suggestions to improve the copyright law protection of variety show mode in China.
